Diese Allgemeinen Geschäftsbedingungen regeln die Voraussetzungen, zu denen die EWE Go GmbH - im Folgenden als „EWE Go“ bezeichnet - Kunden mit Strom an EWE Go Ladestationen beliefert, soweit der Ladevorgang über den Service Intercharge Direct (m.intercharge.eu) der Hubject GmbH gestartet wird.
Der Vertrag kommt folgendermaßen zustande: Der Kunde scannt den QR-Code des gewünschten Ladepunktes an der Ladestation mit seinem mobilen Endgerät, wählt einen der angegebenen Zeiträume mit angegebenen Preis aus, stimmt den Allgemeinen Geschäftsbedingungen zu, wählt ein Zahlungsmittel aus und startet den Ladevorgang, durch Klick auf den Button „Ladevorgang starten“. Durch Klick auf den zuvor genannten Button entsteht der Vertrag zwischen EWE Go und dem Kunden.
Verantwortlicher Anbieter des Internetauftritts von Intercharge Direct (m.intercharge.eu) im datenschutzrechtlichen Sinne ist die Hubject GmbH (EUREF-Campus 22, 10829 Berlin, Tel.: +49 30 7889320-0, E-Mail: info@hubject.com). Auf die Datenschutzerklärung der Hubject GmbH wird hiermit hingewiesen.
Die vom Kunden zur Durchführung des Ladevorgangs an den Ladestationsbetreiber EWE Go übermittelten Daten (Standort des Ladepunktes, Ladedauer und Umfang des Ladevorgangs) nutzt EWE Go ausschließlich zur Abwicklung des Vertragsverhältnisses.
Die vom Kunden auf dem Internetauftritt von Intercharge Direct eingegebenen Zahlungsdaten werden zur Abwicklung an den angebundenen Zahlungsdienstleister Paypal (PayPal (Europe) S.à r.l. et Cie, S.C.A, 22-24 Boulevard Royal, L-2449 Luxembourg) oder für Kreditkartenzahlungen an den Payment Anbieter Stripe (Stripe, Inc., 510 Townsend Street, San Francisco, CA 94103, USA) übermittelt.
Bei der Bezahlung mit Kreditkarte werden automatisch personenbezogene Daten an den Zahlungsdienstleister Stripe übermittelt. Sämtliche für die Zahlungsabwicklung erforderlichen Daten werden ausschließlich für die Durchführung der Zahlungen verwendet und über das Verfahren “SSL” übermittelt. Stripe ist nach PCI DSS zertifiziert. Stripe transferiert, verarbeitet und speichert gegebenenfalls personenbezogene Daten außerhalb der EU. Stripe unterliegt dem EU-U.S. Privacy Shield Abkommen.
Bei der Zahlung mit Kreditkarte handelt es sich bei den zur Abwicklung der Zahlung erforderlichen personenbezogenen Daten um Vor- und Nachname des Karteninhabers, Kartennummer, CVC (Card Validation Code) und Gültigkeitsdatum.
Die Übermittlung der Daten bezweckt die Zahlungsabwicklung.
Stripe nutzt Ihre personenbezogenen Daten zur Verarbeitung der Zahlung, sowie gegebenenfalls zur Kontaktaufnahme im Hinblick auf die Zahlung und zur Bereitstellung von diesbezüglichem Kundendienst.
Stripe gibt die personenbezogenen Daten gegebenenfalls an verbundene Unternehmen, soweit dies zur Erfüllung der vertraglichen Verpflichtungen erforderlich ist oder die Daten im Auftrag verarbeitet werden sollen. Zudem gibt Stripe Daten an Dienstleister der Zahlungsverarbeitung (z.B. Banken, Kreditkartenunternehmen) weiter. Auch wird Stripe die Daten gegebenenfalls an Dritte weitergegeben sofern dies in Hinblick auf die Zahlungsart gesetzlich vorgeschrieben ist oder sofern dies zum Schutz seiner bzw. Ihrer Rechte, zur Durchsetzung seiner Bedingungen oder um Anforderungen von Strafverfolgungsbehörden u.a. zu entsprechen, erforderlich ist. Die Verarbeitung der Daten erfolgt insoweit zur Zahlungsabwicklung und beruht auf Art. 6 Abs. 1 lit. b DS-GVO.
Bitte beachten Sie, dass Stripe zahlreichen Verpflichtungen zur Aufbewahrung der durch Sie bereitgestellten Daten unterliegt; dazu gehört, sicherzustellen, dass Transaktionen angemessen verarbeitet, abgewickelt, erstattet oder rückbelastet werden können, dazu beizutragen, Betrugsfälle aufzudecken, und Geldwäschebekämpfungs- und anderen für Stripe und seine Finanzdienstleister geltenden Gesetzen und Rechtsvorschriften zu entsprechen. Daher bewahrt Stripe zur Erfüllung seiner Verpflichtungen bestimmte Daten auf. Es kann zudem sein, dass Restdaten in seinen Datenbanken und anderen Aufzeichnungen zurückbleiben, die nicht entfernt werden. Die Datenverarbeitung beruht insoweit auf Art. 6 Abs. 1 lit. c DS-GVO.

Außerdem haftet EWE Go soweit zwingende gesetzliche Haftungsregelungen bestehen (z. B. unter dem Produkthaftpflichtgesetz).
c. Bei leicht fahrlässiger Verletzung wesentlicher Vertragspflichten nach Absatz 3 haftet EWE Go nur für vertragstypische und bei Vertragsbeginn vorhersehbare Schäden.
Wesentliche Vertragspflichten sind solche, die die wesentlichen Rechtspositionen des Kunden aus diesem Vertrag schützen. Wesentliche Vertragspflichten sind ferner solche, deren Erfüllung die Durchführung des Vertrages überhaupt erst möglich machen und auf deren Einhaltung der Kunde deshalb regelmäßig vertrauen darf.

These terms and conditions (in combination with instructions at the charging station) cover the requirements by EWE Go GmbH (abbreviation: EWE Go) to supply customers with electricity at charging stations operated by EWE Go if the charging process is initialized by the Intercharge Direct service (m.intercharge.eu - provided by Hubject GmbH).
The terms and conditions in English language is meant for informational purposes only. The German “Allgemeine Beschäftsbedingungen” is the legally binding document. If sections or individual terms of this statement are not legal or correct, the content or validity of the other parts remain uninfluenced by this fact.
The contract is concluded as follows: The customer scans the QR code of the requested charging point at the charging station with his mobile device, selects one of the specified periods with the specified price, agrees to the terms and conditions, selects a payment method and starts the charging process by clicking on the button "start charging". The contract between EWE Go and the customer is created by clicking on the previously mentioned button.
The payment for the charging process is made via the payment service provider Paypal (PayPal (Europe) S.à r.l. et Cie, S.C.A, 22-24 Boulevard Royal, L‑2449 Luxembourg) or, for credit cards, via Stripe (Stripe, Inc., 510 Townsend Street, San Francisco, CA 94103, USA).
A receipt can be called up immediately after the start of the charging process by clicking on the "receipt" button.
Responsible publisher of Intercharge Direct (m.intercharge.eu) in terms of data protection is Hubject GmbH (EUREF Campus 22, 10829 Berlin, Tel.: +49 30 7889320-0, E-Mail: info@hubject.com). Please note the privacy policy of Hubject GmbH.
The data transmitted by the customer to the charging station operator (EWE Go) for the purpose of charging (location of the charging point, charging time and extent of the charging process) are used by EWE Go exclusively to realise the contractual relationship.
The payment data entered by the customer on the Intercharge Direct website is processed by the payment service provider Paypal (PayPal (Europe) S.à.rl et Cie, S.C.A, 22-24 Boulevard Royal, L-2449 Luxembourg) or for credit card payments by the payment provider Stripe (Stripe, Inc., 510 Townsend St., San Francisco, CA 94103, USA). The privacy policies of both providers are hereby referred to.
When paying by credit card, personal data is automatically transmitted to the payment service provider Stripe. All data required for the payment processing are exclusively used for the payments processing and transmitted via the protocol “SSL”. Stripe is certified according to PCI DSS. Stripe transfers, processes and stores personal data if necessary, outside of the EU. Stripe is committed to comply with the EU-U.S. Privacy Agreement.
When paying by credit card, the required personal data for the payment process are the first and last name of the cardholder, card number, CVC (Card Validation Code) and validity date.
The transmission of the data is necessary to process the payment.
Stripe uses your personal data to process the payment and, if necessary, to contact you concerning the payment and the provision of customer service referring to this regard.
Stripe may forward personal data to affiliated companies, if this is necessary to fulfill the contractual obligations. Stripe also forwards data to payment processing service operators (e.g. banks, credit card companies). Stripe may also provide the data to third parties if this is required by law regarding the method of payment or if this is required to protect their rights or your rights. Furthermore, the data could be provided to enforce its terms and conditions or to meet the requirements of the law enforcement authorities, if the data is requested. The data is processed for payment based on Art. 6 Abs. 1 lit. c DS-GVO.
Please note that Stripe is subject to numerous obligations to keep the data that you provide; This includes ensuring that transactions can be processed, reimbursed or repaid appropriately. Further, to support fraud detection and to comply legal rules in terms of protection against money laundering as well as complying further laws and regulations applicable to Stripe and its financial services providers. Therefore, Stripe retains certain data to fulfill its obligations. It could also happen that residual data remain in its databases and other records that are not removed. The data processing is based on Art. 6 Abs. 1 lit. c DS-GVO.

In addition, EWE Go is liable insofar as there are mandatory legal liability regulations (e.g. Product Liability Act).
c. In the event of a slightly negligent violation of essential contractual obligations concerning paragraph 3, EWE Go is only liable for damages being typical for the contract and are also foreseeable at the start of the contract.
Essential contractual obligations are those that protect the essential legal positions of the customer based on this contract. Essential contractual obligations are also those whose fulfillment enables the execution of the contract and on those the customer can therefore regularly rely.
